CMT: προτείνει έφεση στην επιβολή προστίμου της Επιτροπής στην Telefonica

H Ισπανική Ρυθμιστική Αρχή για τις Τηλεπικοινωνίες [The Board of the Comisión del Mercado de las Telecomunicaciones (CMT)] αποφάσισε χθές να προτείνει στην Ισπανική κυβέρνηση να εφεσιβάλλει την επιβολή του υψηλού προστίμου στην ισπανική Telefonica SA (TEF) απο την Επιτροπή.

Η Επιτροπή είχε επιβάλλει πρόσφατα πρόστιμο ύψους 151,9 εκατ. ευρώ στην μεγαλύτερη τηλεπικοινωνιακή εταιρεία της Ισπανίας και της Λατινικής Αμερικής, υποστηρίζοντας ότι η εταιρεία άφηνε ένα ελάχιστο περιθώριο κέρδους στους ανταγωνιστές της στην αγορά του Ίντερνετ υψηλών ταχυτήτων, από το 2001.

Η CMT στην απόφαση της ασκεί δριμύτατη κριτική στην απόφαση της Επιτροπής, αναφέρει ότι πότε δεν ζητήθηκε η συνεργασία της για το θέμα, ότι παρόμοιες πρακτικές παραγκωνίζουν και εποφθαλμιούν τις αρμοδιότητες της CMT και των εθνικών αρχών γενικά, ότι προσπαθεί να ρυθμίσει μια αγορά που είναι ακόμα ανύπαρκτη σε αρκετά κράτη μέλη και ως εκ τούτου εκτός αρμοδιοτήτων της Επιτροπής και κατά παράβαση των συνθηκών της ΕΕ.

CMT requests the Spanish Government to defend the competences of the national regulator, infringed by the European Commission in its decision on the Telefónica case

Barcelona, 12th July 2007. The Board of the Comisión del Mercado de las Telecomunicaciones (CMT) has adopted today an agreement to request the Government to bring an annulment action before the European Court of Justice against the recent European Commission decision which imposed a fine on Telefónica due to an alleged abuse of dominant position in the broadband indirect access market from September 2001 to December 2006.

In its request, the CMT points out that the irregularities, which in its opinion the decision incurs, seriously affect the coherence that ought to guide and prevail in all interventions within the electronic communications markets.

CMT states that the European Commission has never formally asked, in the corresponding proceedings, for the cooperation of the Spanish regulatory authority, in contravention of the provisions of the Framework Directive and the specific directives.
In this sense, this way of proceeding infringes the principle of loyal cooperation that the European Institutions should maintain among themselves and with the national authorities, as set by the European Primary Law and Jurisprudence.

Despite the support showed to CMT by the European Commission in its press release, CMT considers that the European Commission decision seriously and deeply affects CMT’s regulatory competences in particular, and those of all other National Regulatory Authorities (NRAs) in general. In addition, this type of intervention jeopardizes the fulfilment of its objectives of regulation in the benefit of Spanish consumers and promotion of effective competition in the sector through the development of telecommunications infrastructures alternative to those of the incumbent.

In opinion of the CMT Board, and as far as the European Commission decision affects directly the ex-ante intervention regime enforced by CMT – regarding both the price control mechanism for the regional indirect access service (GigADSL), and the decision of not imposing any measure concerning the national indirect access prices (ADSL-IP)-, there is a conflict between the scope of the ex ante regulation (national regulatory authorities) and the ex-post intervention (of the competition authorities). This clash can only be solved either via cooperation between authorities or via decision of the European Court of Justice.

It is also important to point out that the wholesale indirect access is a service that does not exist in many member States and that the European Commission has never considered necessary to impose it as it has understood that is not determinant for the competitive development of its markets.

Finally, the CMT remarks that its objective when requesting this action is strictly the defence of the European Community Law, thus safeguarding the powers, objectives and principles ruling the intervention in sector-specific ex-ante regulation. This objective is absolutely independent from the consequences that the European Commission decision may have on the private interests of the operator involved, which are not and will not, by any means, to be defended by CMT.

Αρχίζω να πιστεύω ότι η κα. Ρέντινγκ θα συναντήσει αρκετές δυσκολίες στην υλοποίηση της ατζέντας της για την πανευρωπαϊκή ρυθμιστική αρχή, στην βιασύνη της μάλιστα να την προωθήσει όσο πιο γρήγορα μπορεί, ασκώντας τέτοιους είδους πιέσεις (θυμίζω και την υπόθεση με την Deutsche Telekom), δημιουργεί παντού αντιπάλους και μάλλον όχι χωρίς λόγο και αβάσιμα.

Είναι πολύ δύσκολο οι κυβερνήσεις των χωρών της ΕΕ να αφήσουν τις ρυθμιστικές αρχές τους να λειτουργήσουν τελείως ανεξάρτητα. Ακόμα και όταν διακυβέβεται το συμφέρον των καταναλωτών, οι αποφάσεις των αρχών συνήθως προσπαθούν να προστατεύσουν τα συμφέροντα των incumbents (Telefonica, OTE, Deutche Telecom, France Telecom, BT κτλ).

Επειδή αυτοί οι τηλ/κοί οργανισμοί απασχολούν και πολύ κόσμο υπάρχει πάντα και η απειλή απολύσεων για τις κυβερνήσεις.

Αρχίζω να πιστεύω ότι η κα. Ρέντινγκ θα συναντήσει αρκετές δυσκολίες στην υλοποίηση της ατζέντας της για την πανευρωπαϊκή ρυθμιστική αρχή, στην βιασύνη της μάλιστα να την προωθήσει όσο πιο γρήγορα μπορεί, ασκώντας τέτοιους είδους πιέσεις (θυμίζω και την υπόθεση με την Deutsche Telekom), δημιουργεί παντού αντιπάλους και μάλλον όχι χωρίς λόγο και αβάσιμα.

Αν έχουμε εξελίξεις υπέρ της στο ζήτημα FTTN, τότε θα έχει και ένα επιπλέον επιχείρημα ο ΟΤΕ για να προστατεύσει τυχόν επενδύσεις του σε FTTx, αλλιώς δε θα τολμήσει καν.
