A UK government minister has suggested banks could sue the Bank of England over new rules that will force them to hold more capital for customer loans, potentially increasing borrowing costs for small businesses.
Andrew Griffith, the City minister, raised the prospect of legal action during meetings with firms worried about how Britain will interpret the global Basel reforms, according to people familiar with the matter who didn’t want to be named discussing private talks.
There is widespread unhappiness among medium-sized banks over the rules that come into force from January 2025. The Basel 3.1 reforms, set by the Basel Committee on Banking Supervision but implemented by local regulators, are intended to make banks’ risk assessment more detailed and consistent. It’s the latest overhaul of the financial system after the 2008 crisis, but the first time the UK has implemented changes outside the European Union.
Critics believe the version proposed by the BOE’s Prudential Regulation Authority will shrink lending to smaller businesses and put the UK at a disadvantage with the EU, which is adopting a lighter touch.
Griffith, who is spearheading the UK government’s push to boost the financial services sector following Brexit, triggered surprise with his suggestion of legal action, according to people familiar with the conversations. Many bankers believe it would be not viable, given the regulated nature of the industry.
A person familiar with the Treasury’s thinking, who asked not to be named discussing a private matter, said the minister recognized the PRA’s role as an independent regulator with responsibility for aligning the UK with international standards.
A Treasury spokesperson declined to comment on Griffith’s behalf.
These tensions follow a year of clashes between the government and the BOE over post-Brexit reforms. The Treasury eventually dropped plans to introduce a power for ministers to intervene in regulators’ decisions from its Financial Services and Markets Bill in an attempt to soothe relations.
Small Businesses
The PRA published its Basel 3.1 plans in November, with a consultation running until March 31. The proposals will not “significantly increase capital requirements,” Phil Evans, the PRA’s prudential policy director, said in a speech in December.
The changes will release capital in some areas — such as mainstream mortgages — but could lead to significantly increased levels in others including loans to landlords and green finance, according to several bank executives who spoke to Bloomberg News.
Smaller banks are likely to be hit harder than bigger ones, which can use their own risk models to reduce the capital burden. Loans by those mid-tier banks to small businesses may attract some of the biggest increases in capital requirements.
“We are really concerned that these proposals will increase SME capital requirements by more than 30%, driving up the cost of lending for SMEs,” according to Richard Davies, chief executive officer of Allica Bank.
Such a tightening would be a setback for the UK, according to Mark Mullen, chief executive officer of Atom Bank. “SMEs are massively important to the economic future of the country in virtually every way,” Mullen said. It could also affect competition among banks. “The growth in lending by challenger banks to SMEs in the past eight to ten years has been a real success story,” Mullen said.
Small lenders have also long held frustrations about the UK’s standards on loss-absorbing capital known as MREL, or minimum requirement for own funds and eligible liabilities, which are tougher than in the EU and US.
Brexit Freedom
While Evans in December heralded the PRA’s role in ensuring the UK is a “safe and stable place to do business,” several industry executives have privately said the regulator was using its Brexit freedoms to raise the regulatory bar, rather than to pursue deregulation that could boost growth. Insurers had a similar experience over changes to the Solvency II capital rules.
Andrew Bailey, BOE governor, has also defended the UK’s approach to Basel, saying the route the EU is taking is “non compliant” with the global benchmark — a view shared in some respects by the Basel Committee, though there are no formal consequences for failing to comply.
Several banks are raising their concerns in response to the PRA consultation, according to some of the people involved. Some are considering whether to make the case that the watchdog is going against its new duty to consider international competitiveness, as required by the government’s incoming Financial Services and Markets Bill.
Even among the banking critics, there is an acceptance that the BOE is ultimately acting in line with its main mandate to secure financial stability. If the government wants to promote its stated agenda of economic growth, they hope ministers might still be persuaded to step in.

Οι κεντρικές τράπεζες συμφώνησαν (εξού και το Basel Agreement) να σφίξουν λίγο παραπάνω το ζωνάρι στις τράπεζες και να τις αναγκάσουν να έχουν μεγαλύτερα αποθέματα κεφαλαίου για να δίνουν δάνεια.
Η Τράπεζα της Αγγλίας είπε να υιοθετήσει αυτούς τους όρους (σε αντίθεση με την ΕΚΤ που είπε να μην τους υιοθετήσει στο 100% - άλλωστε δεν είναι υποχρεωμένη).
Μέχρι εδώ όλα καλά.
Ο υπουργός τώρα που είναι υπεύθυνος γιανα χαιδεύειτα financial services στο City τους είπε πως αυτό που κάνει η BoE είναι λάθος, και πως οι τράπεζες πρέπει να κάνουν μήνυση στην ΒoE. Είχα την εντύπωση πως οι υπουργοί δεν πρέπει να λένε τέτοια πράγματα, αλλά μάλλον μπορούν από ότι φαίνεται.
Στο τέλος το άρθρο λέει πως παρόλο που η BoE εν τέλει κάνει τη δουλειά της, υπάρχει ελπίδα πως η κυβέρνηση θα παρέμβει γιατί η BoE δεν βοηθάει στην ανάπτυξηYou thought there would be a funny slogan here.

Όταν η απέναντι πλευρά έρχεται στο τραπέζι των διαπραγματεύσεων με διάθεση να γίνει ένας λογικός διάλογος όλα γίνονται. Όταν το μόνο που κάνει είναι να σε βρίζει και να απειλεί να πάρει την υπογραφή της πίσω επειδή κλαίγεται ότι την κλέβεις (εφαρμόζοντας την συμφωνία που υπογράψατε) δε γίνεται τίποτα μέχρι να πάει σπίτι του ο τσαρλατάνος Α' και η τσαρλατάνα Β'.

We see how a group of men – given complete power and acting without scrutiny – move from being rational and cautious to dangerously gung-ho. They seem to revel in police being given “marching orders” to go after the general public. Even Simon Case, head of the Civil Service, says how much he’d like to “see the face” of first-class travellers incarcerated in “shoebox” hotels. So how did they get to this stage?
The WhatsApp messages show that things started by pointing out a “contradiction” in lockdown theory. It was not just a flaw, but the flaw: the models did not factor in just how much people watched the news and stayed home. A Treasury official lays it out: “If businesses are seeing revenues collapsing it suggests people are actually complying and not going into restaurants/shops/etc ... so how much additional benefit does ‘locking down’ actually get you?”
It wasn’t just a hunch. Data were then shared with the WhatsApp group showing that 54 per cent of the public were socially distancing and 56 per cent no longer attending social gatherings. So Brits were being sensible, hunkering down. But this, it seems, was secret. “Just for us all to see,” they were told. Still the WhatsApp group was behaving as it should: a genuine exchange of views, in a complex and fast-moving environment. Then, lockdown happened. Fast forward a few months and it was becoming embarrassingly hard to prove a link between lockdown and controlling the virus. Sweden was doing pretty well, in spite of having kept schools, pubs and restaurants open. Rather than ask what there was to learn, Hancock became enraged by what he called the “f-----g Sweden argument” and wanted it quashed. “Supply three or four bullet [points] of why Sweden is wrong,” he asked of his aides. Not whether it was wrong: why it was wrong.
In coming days, this newspaper will show the treatment meted out not just to lockdown critics, but ministers asking awkward questions about what all of this would lead to. This shows the groupthink atmosphere: how hard it was, even as a Cabinet member, to urge caution. By the end, ministers were left in no doubt that anyone who asked questions would be seen by the No 10 team as a problem – or even the enemy. (Even, on occasion, the prime minister himself.)
It’s a classic study of groupthink, but decades of study into so-called cognitive dissonance in political leadership shows we should expect this. The bigger the stakes, the stronger the denial. At a certain stage in a high-stakes drama, the politician starts to see their policies as not just correct but heroic and their critics as confused, malign or ideologically-motivated. A poor backdrop for error correction.
Public opinion also exerted a huge gravitational pull. The original pandemic plans imagined ministers being guided by science but did not envisage a situation where panic would see people demanding lockdown, as they saw happening in other countries, and resisting any relaxation of rules. The temptation to follow public opinion even led to the collapse of parliamentary opposition, as Sir Keir Starmer rubber-stamped every decision. Just a handful of voices were asking difficult questions or arguing for restraint: a small enough number to be easily dismissed as cranks.
There are signs of Boris Johnson growing alarmed at the lockdown machismo of his advisers. To Hancock’s horror, he ended up taking advice from two academics, Raghib Ali and Carl Heneghan, who spotted that the graphs used to sell the second lockdown to the public were based on out-of-date data. “If this illustrates anything,” Johnson says, “it is that red teams can work, but need to be formally established.”
He was right. An effective “red team” was the missing element in Britain’s pandemic response: a unit of experts to identify and flag up flaws in the government’s argument. This was the only way of getting through what had become, by then, a powerful clique of pro-lockdown ministers and officials out to rubbish minority reports. If decisions are made in secret with the Cabinet left in the dark and the opposition having abandoned its post, there is no one to scrutinise. The whole democratic apparatus was suspended. So nothing to stop big mistakes from becoming bigger.

Kατά σειρά ΑΕΠ τα μέλη της Ευρωζώνης: Γερμανία, Γαλλία, Ιταλία, Ισπανία, Ολλανδία, Βέλγιο, Ιρλανδία, Αυστρία, Φινλανδία, Πορτογαλία, Ελλάδα, Σλοβακία, +8 πολύ μικρές οικονομίες.
Από αυτές, είχαν σίγουρα πολύ σκληρότερα μέτρα COVID από την Γηραιά Αλβιώνα σίγουρα η 1, 3, 4, 8, 9, 10, 11.
Από ελαφρώς σκληρότερα ως πολύ σκληρότερα μέτρα (δεν το έχω σίγουρο) οι 2, 6, 7.
Παρόμοια μέτρα η 5 (Ολλανδία) και τα κράτησε και για περισσότερο καιρό.
Συμπέρασμα: τα μέτρα COVID χτύπησαν πολύ πιο βαριά την Ευρωζώνη από τη Γηραιά Αλβιώνα και παρόλα αυτά κάτι άλλο έπαιξε ρόλο και η Ευρωζώνη έχει επανέλθει πολύ πιο γρήγορα. Τι να είναι αυτό το άλλο; Αναρωτιέμαι.

Πολύ συνοπτικά, ενεργειακές τιμές και αυξήσεις, bottlenecks σε αλυσίδες προμηθειών που ήταν ακόμα εμφανέστερες στο ΗΒ λόγω γεωγραφίας (νησί) και παραγωγής, μέτρα Covid που γείωσαν / έδιωξαν όλα τα μη ντόπια εργατικά χέρια, παγκόσμιες αυξήσεις τιμών σε όλα (πάλι λόγω bottlenecks και μέτρων Covid)....
ΠΡΟΦΑΝΩΣ τα lockdown είχαν, έχουν, και θα έχουν τεράστιες συνέπειες οικονομικά (για καιρό ακόμα) όσο και αν θέλει κανείς να το ντύσει διαφορετικά
Όλα μαζί έπεσαν πολύ πιο έντονα στο ΗΒ αλλά όχι λόγω Brexit, αλλού είναι το θέμα του Brexit ως πιο άμεσος αντίκτυπος (εξαγωγές και δυνατότητα να είναι το ΗΒ hub παραγωγής).

Απ'το γραφημα φαινεται ξεκαθαρα οτι το dip των βρετανικων μετρων εχει απολυτη σχεση με το μετα-covid αεπ. Πιο μεγαλο dip, πιο μεγαλο προβλημα.
Ισως να θελες να το αποδωσεις στο ...brexit, αλλα εχει απολυτη σχεση με το ευρος των μετρων που παρθηκαν. Αν δεν επαιρναν μετρα θα ειχαν μικρο impact. Εφοσον πηραν σκληρα μετρα, εχουν μεγαλο impact. Η σχεση μετρων-ΑΕΠ ειναι causal... το οτι εγινε brexit πριν καποια χρονια οχι και τοσο.
Πχ η σουηδια δε πηρε σοβαρα μετρα, δεν ειχε σοβαρo impact περα απ'τον αυτοπεριορισμο του κοσμου που μειωσε λιγο την οικονομικη δραστηριοτητα... εκει ειναι το causality...
